As pernicious as the attack on property the greater attack is upon the person which can be initiated for a variety reasons unrelated to property. George Sutherland, a Supreme Court Justice, stated that the rights to life, liberty and property were so closely related as to be one right. To limit one in his right to use and enjoy property is to limit his freedom and his quality of life. The more his right to enjoy property is curtailed the less freedom, and to deprive a person of all property is to ensure his death. Shelter is property whether it is owned or rented. To deprive one of shelter and clothing, another form of property, in bitter winter is to induce death.
Although this story is fiction in novel form it is history in the making. Due process in the tradition of the founding fathers included all criminal law and all civil law. Both classes of law required a common law jury and a common law court. Administrative law is not mentioned and is therefore not among the enumerated powers given to government and is therefore unlawful, illegal and immoral.
In this story administrative law is declared to be civil law which bypasses due process of law guaranteed to all Americans. When a private citizen is found, through due process of law, guilty of violating statue law that is pursuant to constitutional law he is called a criminal. What then is the definition of elected or appointed or hired government officials who violate statue law pursuant to the constitution? The only definition that fits is criminal. Any illegal act performed by any government official as administrative law is acting under the color of law but not according to the law.
